Trump: 'Supreme Court must come to the RESCUE OF AMERICA'

President Trump unleashed scathing posts about the Supreme Court, chiding its Friday decision to halt his deportations of alleged illegal gang members to El Salvador.

The president also suggested the justices are being played by the “radical left” in the attempt to halt his order ending birthright citizenship, a dispute over which the justices heard oral arguments on Thursday.

“The Supreme Court must come to the RESCUE OF AMERICA,” the president posted on his Truth Social account.

He shared a post by Mike Davis, president of the Article III Project, which said the Supreme Court set dangerous precedent when it said the Trump administration was not giving migrants adequate due process notice before deporting them. 

The White House gave 24 hours’ notice, which the justices said didn’t “pass muster.”

“Let’s get this straight: Obama can drone-strike Americans. But Trump can’t repel foreign terrorists. Biden can import over 10 million illegal aliens. But Trump can’t send them home without years of court process. The American people never agreed to this. Not at our founding. Not after the Civil War. Not anytime since then. Certainly not in the last election. The Supreme Court is heading down a perilous path,” Mr. Davis posted on Truth Social.

A majority of the court blocked the president’s use of the Alien Enemies Act to boot the suspected gang members.

The justices, in an unsigned ruling, said the Department of Homeland Security wanted to give less than 24 hours between the time the migrants were notified of their pending deportation and their removal from the U.S. The court said that does not “pass muster.”

The high court also blocked removals of any of the Venezuelans under the expedited deportation authorities of the Alien Enemies Act, though the justices said migrants who could be removed under the regular immigration law may still be ousted.

The ruling is the latest in a string of caution flags the Supreme Court has waved at Mr. Trump and his team, though the justices stopped short of saying he can’t use the 1798 law for deportation.

They said the issue needs to be sped through the lower courts.

Dissenting from Friday’s ruling were Justices Samuel A. Alito Jr. and Clarence Thomas.

Justice Alito said the Supreme Court lacked jurisdiction to intervene at this point.

“From the Court’s order, it is not entirely clear whether the Court has silently decided issues that go beyond the question of interim relief. (I certainly hope that it has not.) But if it has done so, today’s order is doubly extraordinary,” Justice Alito wrote. “Granting certiorari [or judicial review] before a court of appeals has entered a judgment is a sharp departure from usual practice.”

His opinion also noted, “Due process is flexible, we have stressed repeatedly, and it calls for such procedural protections as the particular situation demands.”

The Trump administration says the Venezuelans in question are members of Tren de Aragua, a gang that has been designated a foreign terrorist organization and which Mr. Trump has proclaimed to be engaged in an “invasion” of the U.S.

That triggers the AEA, the 1798 law that allows for faster deportations than can be done under the regular immigration law.

Lawyers for the Venezuelans dispute the claims of TDA membership, saying some of those who have been deported fled Venezuela to get away from the gang.

Mr. Trump went online to express his frustration, saying this ruling means there could be a drawn-out process for illegals that could take years to resolve.

“The result of this decision will let more CRIMINALS pour into our Country, doing great harm to our cherished American public. It will also encourage other criminals to illegally enter our Country, wreaking havoc and bedlam wherever they go. The Supreme Court of the United States is not allowing me to do what I was elected to do,” he wrote.  

“Sleepy Joe Biden allowed MILLIONS of Criminal Aliens to come into our Country without any ‘PROCESS’ but, in order to get them out of our Country, we have to go through a long and extended PROCESS. In any event, thank you to Justice Alito and Justice Thomas for attempting to protect our Country. This is a bad and dangerous day for America!”

Mr. Trump also noted on Thursday the high court heard arguments over his executive order to end birthright citizenship, where an illegal immigrant who gives birth on U.S. soil is deemed to have given birth to a U.S. citizen — and where foreigners use the clause to visit America to give birth so their baby can have dual citizenship. 

At the center of the dispute is whether district court judges can halt the president’s policies nationwide with universal injunctions.

At least three lower courts have blocked Mr. Trump’s birthright citizenship order.

Legal scholars who have examined the issue generally say the policy violates the 14th Amendment of the Constitution, which guarantees automatic citizenship to “all persons born or naturalized in the United States, and subject to the jurisdiction thereof.” At the very least, they say, it would take an act of Congress, not a presidential order, to redefine the policy.

Mr. Trump said in a lengthy post that America is the only country that lets people go on vacation there to give birth, then grant the baby citizenship.

He said he hopes the justices don’t buy liberals’ arguments.

“The Radical Left SleazeBags, which has no cards remaining in its illegal bag of tricks, is, in a very coordinated manner, PLAYING THE REF with regard to the United States Supreme Court,” one of his Friday posts read. 

“They lost the Election in a landslide, and with it, have totally lost their confidence and reason. They are stone cold CRAZY! I hope the Supreme Court doesn’t fall for the games they play. The people are with us in bigger numbers than ever before. They want to MAKE AMERICA GREAT AGAIN!!!”

A decision in the birthright citizenship dispute is expected by the end of June.
